GENERAL TERMS OF SALE

www.peanut.pt is a website provided by Peanut – Artigos de Puericultura Lda, headquartered at Rua Almirante Gago Coutinho nº 8, 2640-487 Mafra, registered at the Braga Registry, under the unique corporate number 514530170, with a share capital of €50,000.00.

 

TERMINOLOGY TO CONSIDER:

www.peanut.pt – hereinafter referred to as “Site”

Users browsing the Site – hereinafter referred to as “Users”. Users must have full legal capacity and act in a non-professional manner.

User who has validated an order – hereinafter referred to as “Buyer”.

User who visits the Site and may or may not have started a purchase process – hereinafter referred to as “Customer”

General Terms of Sale – hereinafter referred to as “GTS”

 

OBJECT

These Terms and General Conditions of Sale govern the commercial relationship between Peanut and any user who wishes to purchase one or more products sold by Peanut through this Site.

These General Terms of Sale and Guarantees prevail over any other document.

Peanut reserves the right to modify these General Terms of Sale at any time and without prior notice, therefore it is recommended to read them whenever placing an order.

When the order is validated, the customer accepts our General Terms of Sale by clicking the tick-box available for this purpose.

 

PRODUCTS

The products offered for sale by Peanut are those listed on the Site on the day the User consults it, and subject to available stock.

Product photos may show slight differences from the purchased products and do not affect the essential characteristics of the products.

If the Customer requires additional information regarding the essential characteristics of the products – available in the product descriptions – please contact Peanut via email at info@peanut.pt.

If the Customer detects an error between the price and/or the essential characteristics of the product and its presentation on the website, please also contact Peanut at info@peanut.pt. In these cases, the Customer has the full right to cancel their order.

 

PRICE

Product prices are indicated in euros (€) and include the taxes applicable on the day of order placement.

Peanut reserves the right, which the User accepts, to change its prices at any time. However, all products will be invoiced based on the price list in effect at the time the order is registered.

The prices shown do not include shipping costs, which will be presented to the Customer before the final validation of the order.

 

ORDERS

The User may freely browse the different pages of the Site without being obliged to place any product order.

The Customer may register on the site if they wish. To place an order, they must select the desired product(s) by clicking the “Buy” button. This action adds the product to the “Cart”, located at the top right corner.

When the User adds a product to the cart, it is updated in the header showing the number of products and the total value.

Upon adding, a message is displayed to the User with the option to continue shopping or start the “check-out” process.

The Customer may view the summary of selected products at any time by clicking the «View Cart» icon in the top corner of their screen and/or modify or delete all or part of the order. This summary includes the list of products and respective quantities.

During checkout, a form is provided for the Customer to fill in delivery details, with all fields being mandatory.

After filling in this form, billing information is requested, which in most cases will match the delivery details. Therefore, the billing form only optionally requests the tax number. If the User wishes, they may set billing details different from the delivery details and must fill in the provided form accordingly.

During order processing, the Customer can change and correct their data, including the “Cart” contents, delivery, and billing address before final validation of the order.

Products selected and added to the «Cart» are saved for a 24-minute session.

 

PAYMENT

After entering all requested information, the Customer will be presented with the available payment options for their order, through Debit Cards, Credit Cards, PayPal, Multibanco Reference, MBWay.

The Site authorizes the following payment methods:

  • Debit Cards
  • Credit Cards
  • PayPal
  • Multibanco Reference
  • MBWay

All information provided to process payment is encrypted through the S.S.L. protocol (Secure Socket Layer).

(The technical solutions used by Hipay comply with the strictest criteria regarding transaction security and bank data protection. The Buyer’s bank details are never transmitted to Peanut’s computer system.)

 

ORDER COMPLETION

The Customer must click “Complete Purchase” to definitively confirm their order.

After completing/processing the payment, the Site generates a page displaying the order confirmation. A confirmation email with the order number and details will also be sent to the email address provided by the Buyer.

If a product is out of stock, the Buyer will be contacted by Peanut to resolve the situation according to their preference.

In case of an incorrect email address, please contact Peanut at info@peanut.pt. Peanut is not responsible for issues caused by incorrect email addresses.

If the order confirmation is not received within 24 hours of placing the order, the Buyer should contact Customer Support at info@peanut.pt.

Other conditions regarding product returns are governed by the Returns Policy.

 

DELIVERY AND RETURNS

The order will be shipped after validation by the Buyer.

The usual delivery time is 1 to 5 business days for mainland Portugal, and up to 20 business days for the Islands and the rest of Europe, after the order is processed.

This period may be extended for specific items, and the Customer will be contacted if a delay is expected.

During Black Friday and Christmas periods, delays may occur due to the shipping service provider, and timely delivery cannot be guaranteed.

Delivery of ordered products is carried out nationally and internationally.

The invoice for the commercial transaction will be sent to the Buyer along with the order.

Upon receiving the ordered products, the Buyer must check their compliance and immediately report any issues to Peanut. Please consult our Returns Policy for more information.

If the order is returned to Peanut, any return shipping costs may be charged to the Buyer.

Peanut is not responsible for delivery to a third party if requested by the Buyer.

Peanut declines any responsibility for non-delivery or delivery delays caused by force majeure, third-party actions, or reasons attributable to the Buyer. In case of delivery delay, the Buyer should inform Peanut at info@peanut.pt.

 

ORDER CANCELLATION POLICY

If the Customer initiates order cancellation, without responsibility attributed to Peanut – Artigos de Puericultura, Lda, a 3% fee of the total order value will apply to cover administrative costs and commissions related to the cancelled order.

 

RIGHT OF WITHDRAWAL

The Buyer has fourteen (14) business days to notify Peanut of their decision to withdraw from the purchase. This period starts from the day the order is received. To exercise this right, the Buyer must inform Peanut within this period and via mail. For more information, please consult our Returns Policy.

 

LEGAL WARRANTY

Peanut undertakes to comply with the legal provisions in force, as provided in the Consumer Code and Civil Code.

 

PERSONAL DATA PROTECTION

At Peanut, we ensure our Customers are aware of our privacy rules and the terms for processing the data we collect, in strict compliance with applicable law, namely the Regulation (EU) 2016/679 (“GDPR”), and the Portuguese Law 58/2019 implementing GDPR, to the extent not contrary to GDPR, and guidelines issued by the National Data Protection Commission (“CNPD”).

ENTIRE AGREEMENT

These General Terms of Sale and the order confirmation sent to the Buyer constitute the contractual documentation and the entirety of the contractual relationship between the Buyer and Peanut. In case of discrepancies, these General Terms of Sale prevail.

 

FORCE MAJEURE

Peanut is not responsible for any defect, delay, or non-fulfillment of obligations arising from the General Terms of Sale due to force majeure.

 

JURISDICTION

Sales of Peanut Products via this Site are governed by Portuguese law, regardless of the buyer’s country of origin or where the order was placed or delivered. The competent court for any dispute is the court of Lisbon, with express waiver of any other jurisdiction.

 

RETURNS POLICY

The services provided on www.peanut.pt are fully focused on customer satisfaction. In case of dissatisfaction, the Customer may return item(s) within 14 business days after purchase, provided that the returned item(s) meet the following conditions:

  1. Return of the item under the right of withdrawal

For items purchased on www.peanut.pt,  the Customer has 14 days from receipt of the order to return it under the right of withdrawal. The following conditions apply:

  • Presentation of the product purchase invoice
  • The product must be returned in the same condition it was sold (sealed and in its packaging, without signs of opening or use)
  1. Returns due to product exchange:

Returns due to “order exchanges” or “incorrect product sent” (Peanut’s responsibility) are accepted within 14 business days from the date the order is received.

  1. Returns of damaged products

Returns of damaged products received by the Customer, e.g., due to shipping or handling, are accepted within 14 business days of order receipt.

Returns of defective products are accepted within 14 business days of order receipt.

Returns are not accepted for products damaged due to improper or incorrect use by the Customer.

All returns must be made by registered mail. Returns via other channels are not accepted for any product purchased on www.peanut.pt.

 

HOW TO RETURN?

To return a product, the Customer must contact Customer Support via info@peanut.pt (or through the Support Chat on the Site).

When contacting Customer Support, the Customer must provide the order number, invoice number, and reason for return.

Products purchased online on www.peanut.pt may only be returned by registered mail with acknowledgment of receipt (AR) to:

Shipping, processing, and other additional costs are non-refundable.

 

REFUNDS

Refunds will be credited to the Customer’s bank account within 14 business days. Refund speed depends on the issuing bank and is beyond our control.

 

PAYMENT INFORMATION

Europe introduced new requirements for authenticating online payments as part of the Second Payment Services Directive (PSD2).

Strong Customer Authentication (SCA) is a new European regulatory requirement to reduce fraud and make online payments safer. This ensures that electronic payments are executed with multifactor authentication.

This requirement adds an extra step for eligible transactions, where the cardholder is requested by the bank to provide additional information to complete the payment (e.g., a one-time code sent to the phone or fingerprint authentication via the banking app).

SECURE PAYMENT INFORMATION

All confidential data, including payment information, is encrypted and transmitted over secure networks using the SSL (Secure Socket Layer) protocol.

If unauthorized charges appear on your credit card due to any purchase on www.peanut.pt, the Customer must immediately alert their bank.

 

SHIPPING

www.peanut.pt considers the Covid-19 pandemic scenario in its procedures. All hygiene and safety measures recommended by DGS and WHO are followed in order preparation.

Our partners handling shipping also ensure the utmost care in their processes.

 

RULES AND RESTRICTIONS:

  • Orders are shipped from Monday to Friday, excluding public holidays.
  • For all deliveries, the signature of the person receiving the order will be required. This ensures the Customer actually receives the ordered item(s).
  • Usual delivery time is 1 to 5 business days for mainland Portugal, and up to 20 business days for the Islands and the rest of Europe, after the order is processed.
  • This period may be extended for specific items; the Customer will be contacted if a delay is expected.
  • During Black Friday and Christmas periods, delays may occur due to the shipping service provider, and timely delivery cannot be guaranteed.

 

SHIPPING TO A DIFFERENT ADDRESS

When entering billing details during checkout, the Customer may provide a different shipping address within the same country.

Peanut reserves the right to contact the Customer by phone if a shipping address different from the billing address is provided.

If the Customer provides an incorrect, imprecise, or incomplete address, Peanut cannot be held responsible for reshipping or shipping costs.

 

ORDER PROCESSING TIME

The order process begins as soon as your online purchase is completed. Orders will be processed once items are in stock, payment is approved, and the delivery address is verified.

At the time of shipment, the Customer will receive an email notification.

Prices on this web page include VAT but do not include shipping costs, which will be added according to the table below:
